1. Agreement to Terms

By accessing or using the services of Lake Scaping LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

Lake Scaping LLC is a Nevada C-10 licensed contractor specializing in luxury landscaping services throughout Nevada, including Incline Village, Crystal Bay, and surrounding areas.

2. Services Offered

Lake Scaping LLC provides professional landscaping services including but not limited to:

  • Landscape design and installation
  • Hardscaping and outdoor living spaces
  • Irrigation system design and installation
  • Landscape maintenance and enhancement
  • Seasonal landscaping services
  • Custom luxury landscape solutions

All services are provided in accordance with Nevada state regulations and our C-10 contractor license requirements.

3. Service Area

Our services are exclusively available to clients located in the state of Nevada. We primarily serve Incline Village, Crystal Bay, and surrounding Nevada communities. We do not provide services in California or other states.

4. Estimates and Proposals

All estimates and proposals provided by Lake Scaping LLC are:

  • Valid for 30 days from the date of issuance unless otherwise stated
  • Subject to site inspection and final measurements
  • Based on current material and labor costs, which may be subject to change
  • Non-binding until a signed contract is executed by both parties

5. Contracts and Payment Terms

Contract Execution: All projects require a signed contract before work begins. Changes to the scope of work must be approved in writing.

Payment Schedule:

  • Deposit: A deposit of 30-50% may be required before project commencement
  • Progress payments: As specified in individual contracts
  • Final payment: Due upon project completion and client approval
  • Late payments may incur interest charges as permitted by Nevada law

Accepted Payment Methods: Cash, check, credit card, bank transfer, or other methods as agreed upon.

6. Project Timeline and Delays

Project timelines are estimates and may be affected by:

  • Weather conditions and seasonal factors
  • Material availability and supply chain issues
  • Unforeseen site conditions
  • Changes requested by the client
  • Permit delays or regulatory requirements

We will make reasonable efforts to complete projects on schedule and notify clients of any significant delays.

7. Client Responsibilities

Clients are responsible for:

  • Providing accurate property information and access to the work site
  • Obtaining necessary property owner approvals (if applicable)
  • Ensuring pets and children are kept away from work areas
  • Protecting personal property and valuables during service
  • Providing timely feedback and approvals as requested
  • Making timely payments according to the contract terms

8. Property Access and Utilities

Clients must provide:

  • Clear access to work areas and adequate parking for equipment
  • Access to water and electricity as needed for project completion
  • Information about underground utilities, irrigation lines, or other hazards

Lake Scaping LLC is not responsible for damage to unmarked underground utilities or property features not disclosed by the client.

9. Warranties and Guarantees

Workmanship Warranty: We stand behind our work. Installation and construction services are warranted for a period of one (1) year from project completion against defects in workmanship.

Plant Material Warranty: Plant warranties vary by species and season. Specific plant warranties will be detailed in individual contracts. Warranties do not cover damage from:

  • Improper maintenance or watering by the client
  • Extreme weather events, drought, or natural disasters
  • Pest or disease infestations
  • Vandalism or damage by third parties

Exclusions: Warranties do not cover normal wear and tear, client modifications, or failure to follow recommended maintenance.

10. Limitation of Liability

To the maximum extent permitted by Nevada law:

  • Our total liability shall not exceed the amount paid for the specific service giving rise to the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not responsible for pre-existing conditions or hidden defects in client property
  • Claims must be brought within one (1) year of service completion

11. Insurance and Licensing

Lake Scaping LLC maintains:

  • Nevada C-10 contractor license (in good standing)
  • General liability insurance
  • Workers' compensation insurance as required by Nevada law

Proof of insurance and licensing is available upon request.

12. Cancellation and Refund Policy

By Client:

  • Cancellations must be made in writing
  • Deposits may be non-refundable if materials have been ordered or work has commenced
  • Refund amounts will be determined based on work completed and expenses incurred

By Company: We reserve the right to cancel or refuse service for non-payment, unsafe site conditions, or breach of these Terms.

13. Intellectual Property

All landscape designs, plans, and creative work product created by Lake Scaping LLC remain our intellectual property unless otherwise agreed in writing. Clients receive a license to use the design for their property only.

14. Photography and Marketing

We may photograph completed projects for marketing and portfolio purposes. If you prefer your property not be photographed or used in marketing materials, please notify us in writing.

15. Indemnification

You agree to indemnify and hold Lake Scaping LLC harmless from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or negligence.

16. Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of Nevada.

Arbitration: Any disputes arising from these Terms or our services shall be resolved through binding arbitration in Nevada, except where prohibited by law.

Attorney's Fees: The prevailing party in any legal action may be entitled to recover reasonable attorney's fees and costs.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, along with any signed contracts and proposals, constitute the entire agreement between you and Lake Scaping LLC regarding our services.

19. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of modified Terms.
